1. Acknowledgment of Unsupervised Facility
I understand that Pittsburgh Sports Complex LLC (“PSC”) is an unsupervised, self-access indoor sports facility. There are no staff, coaches, referees, or medical personnel on site during rentals unless otherwise stated in writing.
2. Assumption of Risks
Participation in athletic and recreational activities at PSC involves inherent risks, including but not limited to:
- Slips, trips, and falls on playing surfaces or in common areas
- Collisions with other participants, walls, equipment, or fixtures
- Injuries from improper or unsafe use of equipment
- Illness, including communicable diseases
- Overexertion, dehydration, sprains, fractures, concussions, or other serious injury
- In rare cases, permanent disability or death
I voluntarily assume all known and unknown risks associated with my participation or presence at PSC.
3. Release of Liability
In consideration for being permitted to enter and use PSC’s facility, I hereby release, waive, and discharge PSC, its owners, officers, employees, contractors, affiliates, agents, and successors from any and all claims, demands, damages, rights of action, or causes of action, present or future, whether known or unknown, arising from or connected to my use of the facility, including claims of ordinary negligence.
4. Indemnification
I agree to indemnify, defend, and hold harmless PSC from any and all claims, damages, costs, and attorney’s fees arising from my actions, my guests’ actions, or those under my booking, including injury to persons or damage to property.
5. Rules & Conduct
I agree to comply with PSC’s Code of Conduct & Safety Rules, including:
- Wearing clean, non-marking, closed-toe athletic shoes on the court
- No smoking, vaping, or illegal substances
- Food and drink prohibited on the court (water permitted in sealed containers)
- Respecting my rental time and the next group’s schedule
- Supervising minors at all times (if applicable)
6. Security & Surveillance
I understand that PSC operates live and recorded video surveillance for safety and security. I consent to being recorded while at the facility.
7. Property Damage & Cleaning Fees
I am financially responsible for any damage caused by me, my guests, or minors under my care. Excessive cleaning due to misuse or negligence will result in additional fees charged to my payment method on file.
8. Governing Law
This agreement is governed by the laws of the Commonwealth of Pennsylvania. Venue for any dispute shall be in Westmoreland County, PA.
